OurTrips Terms of Service

1. Eligibility and account security

You must be at least 13 years old to use OurTrips. By using the service, you confirm that you meet this age requirement and that the information you provide is accurate. You are responsible for maintaining the security of your account and for all activity that occurs under it. Do not share your login credentials. Notify us immediately at support@ourtrips.app if you suspect unauthorized access.

2. Content you add — ownership and license

You retain ownership of the content you upload, including notes, trip points, and photos ("Your Content"). By uploading content to OurTrips, you grant us a worldwide, royalty-free, non-exclusive, sublicensable license to store, process, transmit, display, and reproduce Your Content solely as necessary to operate and provide the service to you and your collaborators. This license ends when you delete the content or your account.

You represent and warrant that:

• You own or have the necessary rights to share all content you upload.
• Your Content does not violate any third-party intellectual property, privacy, or other rights.
• Your Content is not unlawful, defamatory, harassing, obscene, or infringing.

OurTrips reserves the right to remove content that violates these Terms without prior notice.

3. Privacy

Your use of OurTrips is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We use your data to provide the service, improve reliability, and support your account. We do not sell your personal data. Private-link sharing makes a trip viewable by anyone with that link — review your sharing settings carefully before enabling it.

4. Acceptable use

You agree not to:

• Reverse engineer, decompile, scrape, or create derivative works of OurTrips.
• Use automated tools (bots, crawlers) to access the service without our written consent.
• Interfere with or disrupt servers, networks, or other users.
• Circumvent rate limits, storage limits, or access controls.
• Use the service to transmit malware, spam, or any unlawful material.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

Violation of these rules may result in immediate suspension or termination of your account.

5. Third-party services

OurTrips integrates with third-party services including Google (authentication, analytics, Google Photos), OpenStreetMap (routing), and Open-Meteo (weather). When you use features powered by these services, their respective terms of service and privacy policies apply. We are not responsible for the availability, accuracy, or changes to third-party services.

6. Termination

We may suspend or terminate your access to OurTrips at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using OurTrips at any time. To request account and data deletion, email support@ourtrips.app. Sections 2 (ownership and license for pre-deletion content), 7 (disclaimers), 8 (limitation of liability), 9 (indemnification), and 10 (governing law) survive termination.

7. Disclaimers

OurTrips is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. OurTrips is a trip-planning tool; we are not responsible for travel decisions, travel outcomes, or any real-world consequences arising from your use of the service.

You are responsible for keeping your own backups of any content you consider important. To the maximum extent permitted by applicable law, we are not responsible for the loss, corruption, deletion, unauthorized access to, or unavailability of your content.

Some jurisdictions do not allow the exclusion of implied warranties; if applicable law does not allow full exclusion, this disclaimer applies to the maximum extent permitted.

8. Limitation of liability

To the fullest extent permitted by applicable law, OurTrips and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or related to your use of or inability to use the service, even if advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or related to these Terms or the service shall not exceed the greater of: (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless OurTrips and its operators, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual property or privacy right.

10. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Informal resolution first: Before filing any formal legal action, you agree to contact us at support@ourtrips.app to describe the dispute and allow 30 days for us to attempt an informal resolution.

Binding arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in California, or remotely. The arbitrator's decision is final and may be entered in any court of competent jurisdiction.

Class action waiver: You agree to resolve disputes individually and waive any right to bring or participate in a class action, class arbitration, or representative proceeding.

Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm or protect intellectual property rights.

11. Intellectual property

OurTrips and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of OurTrips and its operators. The OurTrips name, logo, and design are protected by applicable intellectual property laws. You may not use our trademarks or branding without our prior written permission.

12. Changes to these terms

We will post updates on this page with a new effective date. For material changes, we will provide at least 14 days' notice through the app or by email before changes take effect. Continued use after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service before the effective date.

13. Entire agreement and severability

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and OurTrips regarding your use of the service and supersede all prior or contemporaneous agreements or understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
